Terms applicable to AI usage in the modeling industry (“Terms”)

The use of Artificial Intelligence (AI) in relation to models is strictly prohibited by default, unless a specific AI buyout option (Option A or Option B) (“Buyout Option”) has been agreed in writing in connection with a booking confirmation/agreement (“Booking”).

The use of AI is strictly prohibited, including but not limited to the following:

  • The alteration, manipulation, or modification of the model’s likeness, which includes but is not limited to their image, face, voice, body or any other features.
  • AI-generated modifications such as digital replicas, facial alterations, body morphing, deepfakes, synthetic media, or any form of AI-generated content that simulates or mimics the model’s appearance or performance.
  • Generating synthetic models or create “lookalikes” by merging real models’ likenesses to create new avatars, virtual characters or similar.
  • The use of AI to analyze, extract, or gather data from models’ likenesses for any purpose, including creating datasets for AI training.
  • Creating multiple variations from a single capture of the model and/or its likeness, such as altering clothing, settings, or context.
  • Use of the model’s likeness in content for new collections, unrelated campaigns, or third-party brands not covered by the original usage license.

Notwithstanding the foregoing, AI may be used under the conditions defined in the Buyout Options below, which constitute an exhaustive list, and only if expressly agreed in writing as part of a confirmed Booking.

Option A – Limited AI Usage

Scope:

  • Visual adaptations using AI are allowed, provided the model’s physical appearance is not altered or distorted in any way.
  • Examples of permitted use:
    • Background replacement or adjustment (e.g., studio replaced with an urban setting).
    • Lighting adjustments (e.g., from daylight to evening mood).
    • Subtle pose alterations through AI interpolation.
    • Conversion of a still image into a “motion still” (e.g., product rotation or 360° spin)
      • Such are only permitted for product display on the corresponding e-commerce platform.
      • The total animation must not exceed 5 seconds.
      • The model may not speak or interact actively; animation is strictly for product presentation and demonstration.
  • All modifications must preserve the visual integrity of both model and product, meaning that the model and the product depicted must remain unchanged in their original form.
  • Usage is restricted to the product range captured during the original shoot and within the licensed usage scope agreed in relation to a Booking or similar.
  • The AI processing must take place in a so-called closed AI system. Use of public AI platforms and/or databases (e.g., OpenAI) is strictly prohibited.
  • All AI use must comply with applicable statuary provisions, including the EU Artificial Intelligence Act and the General Data Protection Regulation (GDPR)

Option B – Extended AI Usage

Scope:

  • Includes the scope under Option A, along with the following additional permissions:
    • AI may be used to further develop or diversify the product imagery within the same collection or product line.
    • Examples of permitted use:
      • Generating color variations of a product.
      • Creating new combinations using already-photographed items.
      • Generating side or back views based on the original photos.
